- ''During boarding a passenger stripped from the waist down and defecated on the galley floor. He sat in it and rubbed it onto the galley floor and aisle carpets,'' the witnesses' report states.

- (Reuters)'--A federal appeals court ruled on Wednesday that the U.S. Consumer Financial Protection Bureau's funding apparatus is unconstitutional, faulting a system Democrats designed to insulate the agency from requiring congressional appropriations.
- The New Orleans-based 5th U.S. Circuit Court of Appeals ruled that the CFPB's independent funding through the Federal Reserve rather than budgets passed by Congress violated the separation of powers principles in the U.S. Constitution.
- That ruling, by a panel of three judges appointed by then-President Donald Trump, a Republican, in the process vacated a 2017 regulation the agency adopted aimed at combating "unfair and abusive" practices in the payday lending industry.
- The Community Financial Services Association of America sued in 2018 to challenge the rule, which barred lenders from making a new attempt to withdraw funds from an account where two consecutive attempts had failed unless consumers consented.
- "Even among self-funded agencies, the Bureau is unique," U.S. Circuit Judge Cory Wilson wrote. "The Bureau's perpetual self-directed, double-insulated funding structure goes a significant step further than that enjoyed by the other agencies on offer."
- A CFPB spokesperson said there was "nothing novel or unusual about Congress's decision to fund the CFPB outside of annual spending bills."
- The bureau could ask the full 5th Circuit to reconsider the case or take it to the U.S. Supreme Court.
- Multiple other courts have deemed the CFPB's funding constitutional, a point the 5th Circuit acknowledged but disagreed with.
- The ruling marked the latest in a series of legal challenges to the CFPB, which Congress created in 2010 through the passage of the Dodd-Frank Act during Democrat Barack Obama's presidency, in response to the 2008 financial crisis.
- Republicans have long opposed the agency. The Supreme Court in 2020 ruled in another case that the protection Congress originally afforded the CFPB director, who could only be fired for cause, was unconstitutional.

- Threat of rail strike has supply chain ramping up contingency plans

- Logistics managers are dusting off their plans for a possible railroad strike in November that could wreak havoc on the supply chain and cost the U.S. economy up to $2 billion a day.
- The National Carriers' Conference Committee (NCCC), representing the nation's freight railroads in the national collective bargaining, notified the Brotherhood of Maintenance of Way Employees Division of the International Brotherhood of Teamsters (BMWED) on Wednesday that the union's latest proposal will not be accepted. A deal between the rails and several large unions to avert a strike, with recommendations from the Biden administration, was moving closer to completion before being voted down by the BMWED last week.
- "Now is not the time to introduce new demands that rekindle the prospect of a railroad strike," the NCCC said in a statement.
- Tom Nightingale, CEO of AFS Logistics, tells CNBC that logistics managers are fielding calls from customers in anticipation of a possible strike.
- "Prudent shippers already had a plan in place a month ago, and most who did not have now ramped up their contingency planning after the wakeup call last month," Nightingale said. "Proactivity is the key to supply chain success."
- For many intermodal shipments '-- shipments that use multiple modes of transport such as ocean, trucking and freight rail '-- there can be a week between when cargo is picked up and when it makes it onto the rail lines, according to Nightingale.
- "That lag time will exacerbate the effects of delays and service interruptions, so effectively managing the risk of intermodal disruption means you must plan early and often," he said.
- In anticipation of a strike in September, Norfolk Southern, Berkshire Hathaway subsidiary BNSF, CSX , and Union Pacific all began ramping down freight approximately five days ahead of the strike date in an effort to move critical hazmat materials, such as chlorine and ethanol. That freight took priority over common freight.
- "Shippers had a lot of sensitivity to the potential rail strike," Nightingale said. "No shipper wants to lose their job or risk losing a customer when they have had this much advance notice to a looming disruption."
- As a result, AFS saw a significant uptick in customers looking to shift loads away from intermodal to other modes like truckload and even less-than-truckload shipping (LTL).
- "Shippers don't want cargo with a limited shelf life sitting at a rail yard, particularly commodities like chemicals and refrigerated food and beverage," he said.
- Under the Railway Labor Act, Congress has the ability to impose the resolution from Biden's Presidential Emergency Board, or order the trains to operate as usual with an extension of negotiations. Nov. 19 is the earliest that rail unions can strike.
- "While it is premature to make predictions about what could happen in negotiations, railroads will take every necessary and prudent step to ensure the safety and security of the network and the communities we serve," a spokesperson for the Association of American Railroads said in an email to CNBC. "The rail network does not turn on and off like a light switch and advanced planning and positioning of assets takes time. Should uncertainty remain ahead of the status quo expiring with BMWED, past action is a good indicator of how those operational plans are executed, and specific decisions on timing will be made as events necessitate."
- "If you are in logistics and you are not already scenario planning for a potential work stoppage you may be behind the curve right now," said Brian Bourke, chief growth officer of SEKO Logistics. "Everyone is waiting for after the election for any additional movement or news, but the time to start planning is now."
- Anger among union workersOn October 18, the BMWED posted on its website a letter members could use to send to their congressional representatives covering the quality of life and benefits issues, which have been a major sticking point in negotiations over a new contract. One of the key points of contention is the BMWED looking for more paid time off, especially for sickness.
- "The push for paid sick time off could potentially lead to Congressional action," the letter said. "While we hope the carriers will acknowledge the concerns of their employees and negotiate with us, it is important that we are prepared for their unwillingness to address quality of life concerns."
- "The railroads consistently underestimate the frustration and anger of the workers. Workers can't take it anymore," Richard Edelman, counsel for BMWED and chief spokesperson in the collective bargaining, told CNBC. "The Presidential Emergency Board (PEB) ruling is just a recommendation. It is not a lid. Carriers have made the determination of not doing more than the net equivalent of the PEB."
- Union Pacific CEO Lance Fritz told CNBC during an interview on "Squawk on the Street" Thursday morning, "We've got some negotiating to do with that union and we've agreed to status quo, we're in status quo while we're doing that. I am confident we will find a way to craft an agreement that can be taken back out for ratification. That doesn't mean a strike is not possible, it just means in my opinion I don't think it's probable. We've got plenty of runway to figure it out."
- On Sept. 15, before the previous national strike deadline, an agreement was announced by Labor Secretary Marty Walsh between the two largest unions, the Brotherhood of Locomotive Engineers and Trainmen (BLET) and the Sheet Metal Workers' Transportation Division (SMART-TD) and the National Carriers' Conference Committee. The BMWED is the third-largest union with 23,900 members.
- "The railroads have made billions off of their workers," Edelman said. "These are incredibly skilled jobs where sophisticated pieces of equipment are used. The workers do not feel valued."
- One of the worries among logistics experts is workers quitting, but the AAR spokesperson told CNBC that train and engine service headcount was up 7.4% in September compared with January. Fritz told CNBC that UP's attrition rate is near its historical norm this year and it's hiring plan has been right on target, with no indication of any "Great Resignation" at the rail carrier.
- "Those new hires came on board for the same reason most railroaders stay for life '' railroading is a career that allows you to both support a family and take deep pride in your work," the AAR spokesperson said.
- "Workers need to be able to take off when they are sick. Under the present policy workers are penalized. Railroad executives are so deep into their own bubbles they think all of this is okay," Edelman said.

- Australian Bank Begins Linking Customer Transactions to Carbon Footprint '' Summit News
- In another foretaste of potential future 'carbon allowance' limits, a major bank in Australia has introduced a new feature that links purchases to a customer's carbon footprint and warns them when they are going over the average.
- Australia's Commonwealth Bank (CBA) has partnered with Cogo, a ''carbon management solutions'' company, to launch the new feature, which is part of CBA's online banking platform.
- The bank gives the customer the option to ''pay a fee'' to offset their carbon footprint, with the average listed as 1,280 kilograms, a long way from the 'sustainable' figure of 200 kilograms.
- A person's carbon footprint is calculated and then an 'equivalent' metric is show to make the customer feel guilty about it, such as ''8 trees being cut''.
- ''By combining our rich customer data and CoGo's industry-leading capability in measuring carbon outputs, we will be able to provide greater transparency for customers so that they can take actionable steps to reduce their environmental footprint,'' CommBank Group executive Angus Sullivan said in a statement.
- The bank has promised to refine the calculation down to showing how much CO2 individual purchases are responsible for.
- While initially presented as a handy way for someone to track their consumption habits and the supposed impact they have on the environment, some fear that such schemes could one day become mandatory and place limits on purchases of customers who exceed their 'carbon allowance.'
- As we previously highlighted, allied with climate lockdowns, technocrats want to exploit hysteria over climate change to increase financial control over individuals.
- Such a proposal was presented in the science journal Nature by four environmental ''experts'' as a means of reducing global carbon emissions.
- Everyone would be issued with a 'carbon allowance card' ''that would entail all adults receiving an equal tradable carbon allowance that reduces over time in line with national [carbon] targets.''
- The authors make it clear that the program would be a ''national mandatory policy.''
- Carbon units would be ''deducted from the personal budget with every payment of transport fuel, home-heating fuels and electricity bills,'' and anyone going over the limit would be forced to purchase additional units in the personal carbon market from those with excess to sell.''
- Of course, the wealthy would be easily able to afford the offsets, and many of them are directly invested in the trading mechanisms that the scheme would be based on.
- The proposal makes clear that the means of measuring a person's uptake of carbon units for travel would function ''on the basis of the tracking the user's movement history.''
- The authors note that mass compliance with COVID-19 lockdown regulations has greased the skids for further intrusive tyranny and that, ''people may be more prepared to accept the tracking and limitations related to PCAs to achieve a safer climate'' as a result.

- Ari Emanuel is encouraging businesses that work with Kanye ''Ye'' West to end their involvement with him following the rapper's antisemitic remarks.
- In an op-ed for the Financial Times published online Wednesday, the Endeavor CEO wrote that West's business partners, including companies that profit off his music '-- such as Apple, Spotify, Adidas and his touring partners '-- should stop working with the star. Emanuel also said that the parent company of Parler, which on Monday announced West's planned acquisition of the right-wing social media platform, should refuse to sell it to him.
- ''West is not just any person '-- he is a pop culture icon with millions of fans around the world,'' Emanuel wrote. ''And among them are young people whose views are still being formed. This is why it is necessary for all of us to speak out. Hatred and anti-Semitism should have no place in our society, no matter how much money is at stake.''
- Emanuel's essay referenced a 2006 piece he wrote for HuffPost in which he said entertainment companies should stop working with Mel Gibson after the antisemitic remarks he made that year during an arrest for drunk driving. - How Cancer Deaths From the COVID Jabs Are Being Hidden

- As noted in his article, seven out of the 11 International Classification of Diseases (ICD) codes tracked by the U.S. National Center for Health Statistics '-- including cancer '-- saw sharp upticks starting in the first week of April 2021.

- At no point during the past seven years have we seen this rate of new cancer diagnoses. Are the COVID shots to blame? Probably, unless we can identify another widespread environmental factor or exposure that was introduced to the population, en masse, in early 2021, that didn't exist before.
- CDC Fudging Death Records to Eliminate Cancer SignalAccording to The Ethical Skeptic's analysis of U.S. Morbidity and Mortality Weekly Report (MMWR) data, the U.S. Centers for Disease Control and Prevention has been filtering and redesignating cancer deaths as COVID deaths since Week 14 of 2021 to eliminate the cancer signal.4

- So, to rephrase, what The Ethical Skeptic is saying is that 20% of the weekly so-called COVID deaths are actually cancer deaths, which is rather astounding. But swapping the underlying and main causes of death, listing COVID as the main cause, hides (to some degree) the fact that cancer deaths are going through the roof.
- According to his analysis, the COVID shot is killing 7,300 Americans per week. COVID, meanwhile, is killing 1,740 people.7 So, what will the CDC blame when COVID disappears and they can no longer swap the underlying and main cause of death designations?
- Department of Defense Data Showed Massive Cancer RiseUncontrollable turbo-charged cancers the medical establishment had never seen before only started to occur after the rollout of the COVID jabs.8 Data from the Defense Medical Epidemiology Database (DMED), exposed by attorney Tom Renz and Sen. Ron Johnson (above), showed cancer rates among military personnel and their families basically tripled after the rollout of the shots.9

- Hydrogen will be injected into an emergency gas-fired power station for the first time in a pilot backed by the owner of British Gas.
- Centrica has invested in an industry joint venture which will trial using hydrogen at an existing ''peaking plant'' at its Brigg station in Lincolnshire, the Guardian can reveal.
- The pilot, which will launch in the second half of next year, is aimed at examining the role that hydrogen can play in producing power.
- Peaking power stations generally run only when there is a high, or peak, demand for electricity. The 49MW gas-fired station at Brigg is designed to meet demand during peak times or when generation from renewables is low, typically operating for less than three hours a day.
- The pilot is one of 20 projects part-funded by an £8m programme from the Net Zero Technology Centre (NZTC), which receives funding from the UK and Scottish governments.
- Centrica has also increased its stake in HiiROC, the start-up behind the project, from 2% to 5%, a small investment for the £4bn energy giant. In November 2021, HiiROC raised £26m from a collection of investors including Centrica, industrial buyout firm Melrose, investment fund HydrogenOne and carmakers Hyundai and Kia.
- The project is designed to test to the practicalities of mixing hydrogen in with natural gas at a power plant, with the aim of reducing the overall carbon intensity of the site. In its early stages, just 3% of the gas mix is expected to be hydrogen, rising incrementally to 20%. Partners in the initiative hope ultimately to power the plant using just hydrogen and set a precedent to decarbonise other gas-fired peaking plants.
- Hydrogen is produced by splitting water using electricity, with minimal emissions. It is seen as key to decarbonising energy-intensive industries although there is fierce debate over its use and the motivations of the army of lobbyists pushing its cause in Westminster.

- Granted, Grindr is no spring chicken, having been founded when the iPhone was in its infancy. Attitudes toward a Pinterest-like grid of mostly shirtless men, organized by satellite location data, might have been less enlightened at the time. The world has evolved, even as Grindr hasn't changed much'--for better or worse. The company says it still has no proprietary matching algorithm, and there is no Tinder-like swiping. The app is still a very ''visual experience,'' as creator Joel Simkhai described it to the New York Times in 2014. It is used to find instant community'--romantic or otherwise'--wherever users go.
- LGBTQ+ daters have the potential to be a valuable bunch. Pew Research Center data shows dating-app use varies significantly by sexual orientation. While just 28% of straight adults had tried a dating app or site as of a 2019 survey of U.S. adults, 55% of lesbian, gay or bisexual adults had tried one. Perhaps because of its first-mover advantage, Grindr says it has an 85% brand awareness among gay, bisexual, transgender and queer people, and is the best-known gay-dating app among the general population.
- It hasn't paid much for this. Grindr's registration statement shows sales and marketing expenses amounted to less than 1% of its overall revenue last year. Match Group and Bumble spent nearly 19% and 28% of their revenue, respectively, on selling and marketing expenses over the same period.

- Chalk some of that difference up to size. While on pace potentially to expand its top line faster than its competitors this year, Grindr's run rate as of June 30 implies the company will put up about $180 million in revenue this year. Wall Street is forecasting that Match Group will generate about $3.2 billion. Most dating-app companies have several brands under their umbrellas. Match, for example, has more than a dozen, but Grindr has remained something of a lone wolf in the dating space.
- Which raises the question: If Grindr's brand was so valuable, wouldn't a bigger company have bought it by now?
- The concern could be a matter of the company's past missteps, including periods of third-party data sharing of sensitive information such as users' HIV status and the selling of other user information including location'--problems the company says it has long since remedied. Or it could be the more delicate nature of Grindr's mission. Lingering stigma on being ''out'' on a dating app persists to varying degrees by location and culture, which could crimp expansion potential. It is worth noting that predominantly straight dating apps such as Match's Tinder enjoy many LGBTQ+ users.

- Perhaps the biggest unknown is how quickly Grindr can increase monetization. Well over a decade into its existence, Grindr had nearly 11 million monthly active users as of last year across 190 countries, but its paid penetration was still under 6%. By contrast, Bumble had about 9% paid penetration as of September 2020 in less than half the time.
- Grindr will tell you it has only recently started pushing its monetization efforts with the introduction of a few a la carte paid features this year. But the app's simplicity could be working against it financially. While you have to pay to message suitors on Tinder before matching, Grindr is a bit like a digital bar, where users can approach and message whomever they see at no cost. While you can pay to see more (and avoid ads), freemium users can see 100 local singles on Grindr. That seems plenty to work with, given that Grindr's users already spend an average of over an hour a day on the app.
- The public market might not welcome Grindr with open arms. Stock-market investors since 2015 have lost an average of 37% of their investment on SPACs a year after the merger through the end of September, The Wall Street Journal reported this month. Meanwhile, Match and Bumble have shed an average of 68% of their market values over the past year as tech stocks have taken a beating and economic pressures have called into question near-term growth of nonessential spending.

- For more than two years, shuttered schools and offices, social distancing and masks granted Americans a reprieve from flu and most other respiratory infections. This winter is likely to be different.
- With few to no restrictions in place and travel and socializing back in full swing, an expected winter rise in Covid cases appears poised to collide with a resurgent influenza season, causing a ''twindemic'' '-- or even a ''tripledemic,'' with a third pathogen, respiratory syncytial virus, or R.S.V., in the mix.
- Cases of flu have begun to tick up earlier than usual, and are expected to soar over the coming weeks. Children infected with R.S.V. (which has similar symptoms to flu and Covid), rhinoviruses and enteroviruses are already straining pediatric hospitals in several states.
- ''We're seeing everything come back with a vengeance,'' said Dr. Alpana Waghmare, an infectious diseases expert at Fred Hutchinson Cancer Center and a physician at Seattle Children's Hospital.
- Most cases of Covid, flu and R.S.V. are likely to be mild, but together they may sicken millions of Americans and swamp hospitals, public health experts warned.
- ''You've got this waning Covid immunity, coinciding with the impact of the flu coming along here, and R.S.V.,'' said Andrew Read, an evolutionary microbiologist at Penn State University. ''We're in uncharted territory here.''
- The vaccines for Covid and flu, while they may not prevent infection, still offer the best protection against severe illness and death, experts said. They urged everyone, and especially those at high risk, to get their shots as soon as possible.
- Older adults, immunocompromised people and pregnant women are most at risk, and young children are highly susceptible to influenza and R.S.V. Many infected children are becoming severely ill because they have little immunity, either because it has waned or because they were not exposed to these viruses before the pandemic.

No vaccine is available, but at least two candidates are in late-stage clinical trials and appear to be highly effective in older adults. Pfizer is also developing an antiviral drug.
- ''As of today, we are seeing equal numbers of Covid, flu and R.S.V. and that's really concerning because we are very early for flu and R.S.V. activity,'' said Dr. Diego Hijano, a pediatric infectious disease specialist at St. Jude Children's Research Hospital.

- Another Covid wave?Coronavirus cases are low, but are beginning to rise in some parts of the country. Several European countries, including France, Germany and Britain, are experiencing an uptick in hospitalizations and deaths, prompting experts to worry that the United States will follow suit, as it has with previous waves.
- Some of the coronavirus variants that are picking up momentum are adept at dodging immunity and drugs such as Evusheld and Bebtelovimab, which are especially important for protecting immunocompromised people.
- People with weakened immune systems ''remain at risk even despite getting all of the recommended or even additional doses of vaccine,'' Dr. Waghmare said.
- Public health experts are particularly concerned about a constellation of Omicron variants that seem to dodge immunity from the vaccines and even from recent infection better than previous variants did.
- The latest booster vaccines made by Pfizer and Moderna were designed for the variants that dominated this summer but not for these newer variants. Still, they raise antibody levels overall, and should help stave off severe symptoms and abridge the duration of illness, said Aubree Gordon, an epidemiologist at the University of Michigan.
- The BA.5 variant was the most immune evasive variant until recently, but it is rapidly being replaced by others, including two that show an even greater ability to sidestep immunity.
- One of them, known as BQ.1.1, is the leading candidate for causing a winter wave, and it has already sent cases soaring in Europe. Although it and a closely related variant called BQ.1 together account for only about 11 percent of cases in the United States, their share has grown rapidly from just 3 percent two weeks ago.

Its subvariant XBB.1 has just arrived in the United States. Another variant, called BA.2.75.2, is also highly immune evasive and causes more severe disease, but is so far responsible for less than 2 percent of cases nationwide.
- Most of the other variants don't appear to cause more severe symptoms than earlier versions of the virus, but the trend toward immune evasiveness is likely to continue, experts said.
- ''Now things have shifted with the massive degree of immunity that people have against previous variants,'' said Cornelius Roemer, a computational biologist in Richard Neher's group at the University of Basel.
- The Food and Drug Administration has authorized boosters designed for BA.5 for all Americans 5 and older, but so far, only a small fraction of people who qualify for a shot have received one. Fewer than one in three children ages 5 to 11 has completed even the primary series of Covid vaccines.
- That may change as people see a rapid rise in cases, Dr. Gordon said.
- Signs of a bad flu seasonBefore the coronavirus walloped the world, flu viruses sickened millions each winter, and killed tens of thousands of Americans. In the 2018-2019 season, the flu was responsible for 13 million medical visits, 380,000 hospitalizations and 28,000 deaths.
- Flu season in the southern hemisphere, typically between May and October, is highly predictive of winters in the northern hemisphere. This year, flu began weeks earlier than usual in Australia and New Zealand, and the number of cases and hospitalizations were markedly higher.
- Dr. Gordon tracks influenza rates among children in Nicaragua, which has one flu season in June and July, and a larger one in the late fall. More than 90 percent of the population was considered fully vaccinated against Covid by January 2022, and many people had also gained immunity from one or more infections.
- Still, the country saw high rates of both Covid and influenza in the first half of this year. Influenza rates among children were higher than in the 2009 flu pandemic, and the children were sicker on average than in previous years. ''We saw a lot of hospitalizations,'' Dr. Gordon said.

But in some states, this year's season is already underway.
- About 3 percent of tests nationwide were turning up positive for flu as of Oct. 8, according to the C.D.C., but the rates are higher than 10 percent in some Southeastern states and higher than 5 percent in the South Central region. In Texas, the proportion of tests positive for flu jumped to 5.3 percent in early October from 3.7 percent the week before.
- Some southern states are also reporting a rise in the use of ventilators. In New York, health officials declared early this month that flu was already widespread in the state.
- Public health experts urged Americans, especially those at high risk, to get a flu shot before cases rise much higher. Like the Covid vaccines, the flu vaccine may not be a perfect match for the circulating variant, but even so, it roughly halves the risk of hospitalization in both children and adults.
- Antibodies kick in roughly two weeks after a shot, so a vaccine now may in fact extend protection through the winter wave better than one received in September.
- Last year, flu vaccination rates decreased slightly in all age groups compared with the previous year, according to an analysis by the C.D.C. The vaccination rate for children 6 months to 4 years of age, who are at high risk, showed the biggest drop '-- to 67 percent from 75 percent before the arrival of the coronavirus.
- The lower rate may be because mistrust of Covid vaccines has spilled over to those for the flu, or simply because parents have forgotten the danger flu poses to young children. It is too soon to tell whether the numbers will improve this year.
- Older adults and immunocompromised people should get both Covid and flu shots, public health experts said. Healthy young adults may also want to opt for both vaccines if they don't want to get sick or cannot afford to miss work, or to protect others around them who are at higher risk.
- Some communities are at increased risk of severe illness and hospitalization for flu. During flu seasons from 2009 to 2022, rates of hospitalization were 80 percent higher among Black adults, 30 percent higher among American Indian/Alaska Native adults and 20 percent higher among Hispanic adults compared with white adults, according to a C.D.C. report released this week.
- Yet flu vaccination rates were much lower in these groups. Vaccine coverage also declined by about 9 percentage points from the previous year in pregnant women across all racial and ethnic groups.
- In February 2020, Dr. Gordon was preparing to talk to her 7-year-old daughter's class about the coronavirus when a boy in the class died of an infection with influenza B virus.
- ''Most of the time it doesn't make you very sick, but sometimes it can,'' Dr. Gordon said of the flu. ''We do have an effective vaccine against influenza, so I'd encourage people to go get vaccinated.''
- Teva stonewalling Senate opioid probe, top Democrat on Homeland panel charges | S&P Global Market Intelligence
- Teva Pharmaceutical Industries Ltd. has been hampering a Senate investigation into the role that drugmakers and distributors have played in driving the opioid epidemic plaguing the U.S., Sen. Claire McCaskill, D-Mo., charged.
- McCaskill, ranking member on the Senate Homeland Security and Government Affairs Committee, said Teva refused to turn over information related to the probe, which "suggests they have something to hide."
- "I'd hope that everyone involved or associated with the company takes note that they're dealing with an entity that's stonewalling a Senate investigation examining a national public health crisis," McCaskill said.
- The Missouri lawmaker's accusation came on the same day that the Centers for Disease Control and Prevention reported that visits to U.S. hospital emergency rooms for suspected opioid overdoses have shot up 30% across the nation.
- McCaskill launched her investigation last year, seeking information from several drugmakers, including Purdue Pharma LP, Johnson & Johnson, Mylan NV, Insys Therapeutics Inc., Depomed Inc., Endo International PLC and Allergan PLC, about their sales and marketing materials, internal addiction studies, details on compliance with government settlements and donations to third-party advocacy groups.
- She also requested information from distributors McKesson Corp., AmerisourceBergen Corp. and Cardinal Health Inc.
- But McCaskill said: "Teva has been an outlier throughout our investigation, and they can rest assured that I'll continue to pursue every possible avenue to get them to comply for as long as it takes."
- Teva spokeswoman Kaelan Hollon told S&P Global Market Intelligence that the company shared McCaskill's concern about opioid abuse and noted that the drugmaker has held "multiple meetings" with the senator's senior staff "in an effort to provide information that would assist in identifying collaborative solutions to this national crisis."
- Teva's lawyer, James Matthews of Foley and Lardner LLP, also said that the company had engaged in several communications with the senator or her staff, including a 90-minute discussion in July 2017 when the company went "into depth about channels of distribution and practices and methods for identifying, investigating and reporting potentially suspicious orders."
- In an Oct. 5, 2017, letter to the senator, Matthews had said that Teva's lengthy discussions had "fully and fairly covered virtually all" of the topics at "an appropriate level of detail" on the matters for which McCaskill was seeking information.
- He acknowledged, however, that the company had declined to produce the documents the senator had specifically requested.
- "We do not believe that these specific documents will advance your stated goal: 'to understand the role of manufacturers and distributors in overseeing opioid shipments and preventing diversion,'" Matthews wrote.
- "It seems likely that publicly disclosing specific and sensitive proprietary information about Teva's customers will chill the willingness of such customers to share information with your committee and participate in our collective efforts to address opioid abuse," he said.
- Matthews argued that McCaskill had access to much of the information she was seeking through the U.S. Drug Enforcement Administration, or DEA, which was in the "best position to make decisions about the appropriateness of disclosing such sensitive information publicly."
- The records McCaskill had requested could, if publicly released, be potentially misused in pending litigation brought by states and municipalities against drugmakers '-- lawsuits that were "without merit," Matthews said.
- "These suits stand as an obstacle to constructive dialogue and collaborative efforts aimed at addressing opioid addiction, wasting time and money on litigation that could be better spent working together to find effective solutions," he said. "In such an environment, Teva has a responsibility to be judicious in determining what documents and information to release publicly."
- As the ranking member of the Senate Homeland panel, McCaskill lacks the power to compel Teva to cooperate with her demands, and the chairman of the committee, Sen. Ron Johnson, R-Wis., refuses to subpoena the Israeli company.
- So for now, it is unclear what more McCaskill can do to get Teva to turn over the documents she is seeking.
- President Donald Trump, however, last week insisted that pharmaceutical companies that helped fuel the opioid epidemic should face federal litigation.
- Attorney General Jeff Sessions revealed Feb. 27 that the U.S. Department of Justice planned to file a so-called statement of interest in a lawsuit against a number of drug manufacturers and distributors accused of using false, deceptive and unfair marketing practices.
- In its March 1 request, the Justice Department asked Judge Dan Polster of the U.S. District of the Northern District of Ohio in Cleveland, who is overseeing more than 350 lawsuits brought by various municipalities, to give the federal government 30 days to decide whether to participate in the litigation.
- Meanwhile, Sen. Joe Manchin, D-W.V., introduced legislation aimed at restoring certain authorities to the DEA so it can better rein in drugmakers and distributors selling large numbers of opioid pills to rogue pharmacies and doctors '-- powers that were weakened under a 2016 law.
- That law was co-authored by Rep. Tom Marino, R-Pa., who Trump initially picked to lead the White House Office of National Drug Control Policy, or ONDCP '-- the nation's drug czar.
- Marino withdrew from the nomination in October 2017 after a public outcry when a news investigation revealed his law had impeded the DEA's ability to stop opioids from flooding several communities.
- The ONDCP is now being run by James Carroll, who is overseeing the office in an acting capacity while awaiting Senate confirmation.
- In a March 5 statement, Manchin said his bill would amend the "substantial likelihood" standard to a "probable cause" standard and would strike the provisions that added the option of a "corrective action plan," which the lawmaker said has slowed down the DEA's ability to suspend suspicious opioid orders.

If you are applying the patch for someone, wash your hands with water only immediately after applying or removing the patch.
- After use, the patch still contains enough medication to serious harm someone who is not using fentanyl. When you remove the patch, fold it in half, so the sticky side sticks to itself. Return the used patches to your pharmacy for safe disposal. Do not discard the used patch in the household garbage.
- Dependence and withdrawal: As with other opioid medications (narcotics), fentanyl may become habit-forming if taken for long periods of time. If you have a history of past or current substance use problems you may be at greater risk of developing abuse or addiction while taking this medication. Drug abuse is not a problem for people who require this medication for pain relief. Physical dependence (a need to take regular doses to prevent physical symptoms) has been associated with some narcotic analgesics.
- Withdrawal symptoms may be experienced if the dose is significantly reduced or suddenly discontinued. Reducing the dose gradually under medical supervision can help prevent or decrease these withdrawal symptoms when this medication is no longer required for pain control.
- Difficulty breathing: Fentanyl can cause serious and life-threatening breathing problems. If you experience slowed breathing or difficulty breathing, seek immediate medical attention. If you have lung problems and are taking other medications that can slow breathing, you are more at risk of experiencing these symptoms.
- Make sure you follow the instructions on how to properly use this medication. If you have any questions, contact your doctor or pharmacist. If you have a chronic lung condition, such as bronchitis, emphysema, or asthma, discuss with your doctor how this medication may affect your medical condition, how your medical condition may affect the dosing and effectiveness of this medication, and whether any special monitoring is needed.
- Drowsiness/reduced alertness: This medication may impair the mental or physical abilities required for certain tasks, such as driving a car or operating machinery. Do not drive or operate dangerous machinery while using this medication until you have determined how this medication affects you.
- Fever or heat exposure: If you develop a fever you may get higher doses than expected from the patch because the release of medication depends on heat. Tell your doctor if you develop a fever, and have a plan in place in the event that your body temperature rises.
- Avoid exposing the application site to direct external heat sources, such as heating pads, electric blankets, heated water beds, heat lamps, hot water bottles, saunas, hot whirlpool spa baths, or intensive sunbathing. This exposure to heat can cause the patch to release too much medication.
- Head injury: If you have head injuries or increased pressure in the head you may have a higher risk of experiencing side effects (breathing problems) or worsening of your condition while taking this medication. Discuss with your doctor how this medication may affect your medical condition, how your medical condition may affect the dosing and effectiveness of this medication, and whether any special monitoring is needed.
- Kidney function: The kidneys are partially responsible for removing fentanyl from the body. If you have reduced kidney function you may experience increased side effects of fentanyl as a result of it not being removed as quickly as expected.
- If you have kidney disease or reduced kidney function, discuss with your doctor how this medication may affect your medical condition, how your medical condition may affect the dosing and effectiveness of this medication, and whether any special monitoring is needed.
- Liver function: Fentanyl is broken down by the liver so it can be removed from the body through the kidneys. Liver disease or reduced liver function may cause a build-up of fentanyl in the body and cause side effects. If you have liver disease or decreased liver function, discuss with your doctor how this medication may affect your medical condition, how your medical condition may affect the dosing and effectiveness of this medication, and whether any special monitoring is needed.
- If you experience symptoms of liver problems (e.g., abdominal pain, persistent vomiting, feeling unwell, fever, itching, yellowing of the skin and eyes, dark urine), contact your doctor immediately.
- Slowed heart rate: This medication can cause a serious and life-threatening reduced heart rate. If this occurs, seek immediate medical attention. If you have an irregular heartbeat and are taking other medications that can slow heart rate, you are more at risk of experiencing these symptoms.
- If you have a slowed heart rate or heart rhythm problems, discuss with your doctor how this medication may affect your medical condition, how your medical condition may affect the dosing and effectiveness of this medication, and whether any special monitoring is needed.
- Stopping medication: Do not stop using fentanyl abruptly, since withdrawal symptoms may occur if fentanyl is stopped suddenly. These symptoms include seizures, irritability, sleep problems, agitation, tremors, diarrhea, abdominal cramps, vomiting, headache, muscle cramps, extreme anxiety, tension, restlessness, sweating, and confusion. Your doctor will advise you on how to safely stop taking fentanyl if you no longer require it for pain control.
- Tolerance: Fentanyl transdermal patches may lead to tolerance when used for a long period of time. Tolerance means that your body gets used to the medication so that more medication may be needed to produce the same pain relief. Your doctor will recommend the dose of fentanyl patch that is most appropriate for you. Do not change your dose or the way you are using the medication on your own. Speak to your doctor if you have any questions.
- Pregnancy: Fentanyl crosses the placental barrier and may cause harm to an unborn baby. Withdrawal symptoms have been noted in newborns of mothers who used fentanyl during pregnancy. - Officials at the Food and Drug Administration (FDA) placed Adderall on their official drug shortage list this week.
- ''The FDA is in frequent communication with all manufacturers of amphetamine mixed salts, and one of those companies, Teva, is experiencing ongoing intermittent manufacturing delays. Other manufacturers continue to produce amphetamine mixed salts, but there is not sufficient supply to continue to meet U.S. market demand through those producers,'' the agency said in its October 12 announcement.
- Last month, experts reported that production delays, regulations, overprescription, and increased demand were all playing a role in making Adderall, the popular ADHD drug and central nervous system stimulant, hard to come by.
- ''Last week, I needed my ADHD prescription refilled, but no pharmacy in my area had any,'' Laura, a writer living in downtown Los Angeles, told Healthline in early September. ''Not the big chains, not the independents. I'm in Los Angeles, not some small town.''
- Among small pharmacies, more than 6 in 10 reported having difficulty obtaining the drug, according to a National Community Pharmacists Association survey of around 8,000 pharmacy owners and managers.
- Teva Pharmaceuticals, the biggest seller of branded and generic Adderall, reported supply disruptions that could last into the fall.
- But it's not just production troubles among a single manufacturer that is responsible for shortages of the medication.
- ''In 2021, Adderall prescriptions went up to 41 million from 37 million the year before. The rise in demand has been linked to the ongoing pandemic as more people are struggling with anxiety,'' Dr. Harold Hong, a psychiatrist at New Waters Recovery in North Carolina, told Healthline.
- ''People who take high doses of Adderall without a prescription can develop a tolerance for the drug, leading them to seek out more medication,'' Hong added. ''This amplifies the demand for Adderall and creates a greater strain on the supply.''
- If you find yourself short on medication, you might experience an Adderall ''crash,'' a condition that includes symptoms such as trouble sleeping, panic attacks, depression, suicidal ideation, and sluggishness.

- Adderall and other ADHD treatments are scheduled substances that can be habit-forming, so the federal Drug Enforcement Administration (DEA) sets quotas on how much of these drugs can be produced.

- And more legitimate telehealth companies have also fallen under scrutiny, with one company, Cerebral, facing simultaneous DEA and Department of Justice investigations involving prescriptions of the drug.
- That makes figuring out just how much Adderall is being overprescribed hard to establish.
- ''The greater availability of Adderall tablets online amid the unlawful sale of drugs over the internet makes it difficult to decipher how much of the drug is being overprescribed,'' Hong said.

- I have been taking Adderall (generic) for a couple months now and am doing pretty well on it. But, I am having some bad GI effects, I am reading that Teva is the best manufacturer for the generic version, but I am not seeing that they are currently making it anymore. The generic I am taking is from Aurobindo Pharmaceuticals and I am reading on hear that they are the worst. I need the IR version and not the XR version of Adderall. So, who is now making the best? Please help.
- Completely agree Aurobindo tablets are awful, core-pharma had the best ones they were pink circles cross scored on the back into 4 sections. Orange oval shaped Tevas are ideal tabs , or orange circle ones E 404 on front, and cross scored into 4 equal sections on back manufactured by Sandoz , these are the best 2 generics available now, in my opinion. I know Teva discontinued a lot of their lower dosages are 7.5s, 12.5s , but not 20s or 30s, i fill th 30mg tabs, I got them from wallgreens,not at cvs if that's where you're going they tend to dispense the Aurobindo tabs all the time. Try wallgreens, or Costco they had been stocking the Sandoz version( they don't require a costco membership to use their pharmacy) they have multiple manufacturers available to them as well. If you go to small privately owned pharmacies you can request they order from your chosen manufacturer. And yeah stay away from Aurobindo... hope I helped

- There are many drugs other than psychostimulants that can be used to treat ADHD.
- Nonstimulant therapyStrattera® (atomoxetine) is the first nonstimulant medication approved by the Food and Drug Administration (FDA) for the treatment of attention-deficit/hyperactivity disorder (ADHD). Strattera and all the other nonstimulants are generally considered to be less effective than psychostimulants in treating ADHD. The nonstimulants are usually considered second- and third-line medications.
- Strattera works on the neurotransmitter (chemical in the brain that transmits nerve impulses) called norepinephrine. Like the stimulant drugs, Strattera is effective in treating and controlling ADHD symptoms. Unlike stimulant drugs, Strattera is not a controlled substance. Therefore, people are less likely to abuse or become dependent on it.
- In addition, Strattera doesn't cause many of the potential side effects linked to psychostimulants, such as sleeplessness. Strattera can cause very significant abdominal pain, nausea and drowsiness, especially when starting the medication. Strattera tends to offset the effect of the stimulant starting to work and then wearing off. At times, it still should be taken more than once a day.
- How does Strattera work?This medication works by increasing the amount of norepinephrine, an important chemical in the brain. Doing this appears to help ADHD by increasing attention span and reducing impulsive behavior and hyperactivity.
- Who should not take Strattera?There are certain situations in which you shouldn't take Strattera. If you or your child has any of the following conditions, you should inform your healthcare provider before taking Strattera:
- Allergy to Strattera or any of its components.Narrow angle glaucoma (a condition that causes increased pressure in the eyes and can lead to blindness).Treatment with a type of medication called monoamine oxidase inhibitors (MAOIs), such as Nardil® (phenelzine), Parnate® (tranylcypromine), Marplan® (isocarboxazid) or Emsam® (selegeline transdermal system) within 14 days of starting Strattera.An adrenal problem called pheochromocytoma or a history of this condition.Severe heart disease.What are the side effects of Strattera?The most common side effects in children and adolescents are:
- Upset stomach (e.g., nausea, vomiting).Decreased appetite, which may cause weight loss.Nausea.Dizziness.Headache.Mood swings.Insomnia.Drowsiness.Abdominal pain.The most common side effects in adults are:
- Constipation.Dry mouth.Insomnia.Erectile dysfunction.Urinary tract abnormalities (e.g., trouble passing urine, pain with urination).Painful menstruation.Hot flashes.These side effects can be significant and may require stopping the medication.
- However in most cases, these side effects are generally not severe. Only a very small percentage of patients needed to stop Strattera due to side effects experienced during clinical trials.
- Allergic reactions to Strattera are rare but do occur, usually as swelling or hives. Tell your provider right away if you or your family member taking Strattera develops a skin rash, swelling, hives or other allergic symptoms.
- There have been reports of slightly decreased growth in children and teens taking Strattera. It's recommended that children and adolescents be observed, measured and weighed periodically while on Strattera.
- Strattera should be stopped if you have signs of jaundice '-- yellowing of the skin or whites of the eyes. Jaundice is a sign of liver damage. Itching, right upper belly pain, dark urine and unexplained flu-like symptoms may also be signs of liver injury. If blood tests show evidence of liver damage, stop taking Strattera.
- Strattera can increase suicidal thinking in teens who take the drug. Patients should be monitored for suicidal thoughts and actions while taking Strattera®.
- Strattera can cause serious heart-related complications (e.g., heart attack, stroke), high blood pressure and increased heart rate especially if you have a history of heart and/or vessel disease and/or irregular heart rate. Therefore, patients should be evaluated for heart disease prior to starting Strattera and be monitored for changes in blood pressure and heart rate during therapy.
- Strattera should be discontinued if symptoms of psychosis (such as hearing voices, believing things that are not true, being suspicious) or mania occur.
- Aggressive or hostile behavior may occur. Therefore, monitoring for this type of behavior during Strattera therapy is recommended.

- Antidepressants, however, are generally not as effective as stimulants or Strattera at improving attention span and concentration.
- Antidepressants used for treating ADHD include the following:
- Tricyclic antidepressants, such as Pamelor' (nortriptyline), Tofranil® (imipramine) and Norpramin® (desipramine) have been shown to be helpful in children and adults with ADHD, but they can cause some unpleasant side effects, such as dry mouth, constipation or urinary problems. They are also relatively inexpensive.Wellbutrin® (bupropion), a different type of antidepressant, has been found to be effective in treating ADHD in adults and children. It's generally well-tolerated, but it also has some side effects that may be a problem for some people who have anxiety, headaches or seizures.Effexor® (venlafaxine) and Effexor XR® (venlafaxine extended-release) are newer antidepressants that increase the levels of norepinephrine and serotonin in the brain. The drugs are effective at improving mood and concentration in adults as well as children and teens. They are occasionally used to treat ADHD.Monoamine oxidase inhibitors (MAOIs) are a group of antidepressants that can treat ADHD with some benefit, but are rarely used because they have significant and sometimes serious side effects and can dangerously interact with certain foods and other medications. - How do these drugs treat ADHD?How these drugs work in treating ADHD is not yet known, but it is clear that they have a calming effect on certain areas of the brain.

- The interference first came to light on Monday afternoon when the FAA issued an advisory over ATIS (Automatic Terminal Information Service). It warned flight personnel and air traffic controllers of GPS interference over a 40-mile swath of airspace near the Dallas-Fort Worth airport. The advisory read in part: ''ATTN ALL AIRCRAFT. GPS REPORTED UNRELIABLE WITHIN 40 NM OF DFW.''

- Civilian GPS relies on low-power satellite signals broadcast in the L band, a radio frequency range that's also used by civilian terrestrial radio sources, including 5G mobile devices. That makes GPS susceptible to unintentional interference from the rollout of this next-generation technology. Equipment used on military bases is also a frequent cause.
- Typically, however, when unintentional interference occurs, authorities can pinpoint the cause within a few hours. - The water superintendent for Richmond, Vt., resigned this week after admitting that he had been lowering the fluoride levels in the town's water below state guidelines for more than a decade.
- In a five-page resignation letter dated Oct. 17, the superintendent, Kendall Chamberlin, said he had lowered the fluoride level to 0.3 parts per million. The state recommends a level of 0.7 parts per million to protect residents' dental health.
- Josh Arneson, the town manager, said in an email that he was first made aware of the fluoridation issue when the state's health department reached out to him in June. The department informed him that the town's water supply, which services 1,000 people, had not reached optimal fluoridation in more than three years. Mr. Arneson then followed up with the agency in September. Mr. Chamberlin '-- who was the water superintendent for over 30 years '-- later confessed in his resignation letter that the town's water had not met the state's recommended fluoride level since 2011, by his design.
- At a Richmond Water and Sewer Commission meeting on Sept. 19, Mr. Chamberlin said that he had spoken with some Richmond residents who supported lower fluoride levels. But others were shocked to learn about his actions, which were first reported by the local news outlet Seven Days.

- The Newsmax cable news outlet has severed ties with Lara Logan after the former ''60 Minutes'' correspondent went on a bizarre rant alleging that world leaders ''dine on the blood of children.''
- Logan, an award-winning former war correspondent, was interviewed Wednesday by Newsmax host Eric Bolling, who anchors a show called ''The Balance.''
- Bolling invited Logan to his program to discuss global elites and their favoritism toward leftist policies. He then asked Logan about the situation along the southern border, where undocumented migrants have crossed into the United States in droves.
- ''God believes in sovereignty, and national identity, and the sanctity of family, and all the things that we've lived with from the beginning of time,'' Logan responded. Her comments were transcribed by the news site Mediaite.
- Logan repeated a ''blood libel'' in which she accused world leaders of ''dining on the blood of children.'' Newsmax''And he knows that the open border is Satan's way of taking control of the world through all of these people who are his stooges and his servants.''
- Logan then added: ''And they may think that they're going to become gods. That's what they tell us. You've all known [historian Yuval Noah] Harari and all the rest of them at the World Economic Forum.
- ''You know, the ones who want us eating insects, cockroaches, and that while they dine on the blood of children?''
- Logan added: ''Those are the people, right? They're not gonna win. They're not going to win.''
- ''Newsmax condemns in the strongest terms the reprehensible statements made by Lara Logan and her views do not reflect our network,'' Newsmax said in a statement to the Daily Beast. ''We have no plans to interview her again.''
- Before appearing on Newsmax, Logan made frequent contributions to the Fox Nation streaming service run by Fox News '-- which is owned by the Fox Corporation, the sister company to The Post's corporate parent, News Corp.
- Logan's career was once promising. More than a decade ago, she was CBS News' chief foreign affairs correspondent. - The South African-born Logan began hosting ''Lara Logan Has No Agenda'' on Fox Nation after parting ways with CBS News in 2019.
- Last November, Logan was dropped by her talent agency after she compared Dr. Anthony Fauci to Josef Mengele. Vivien KillileaLogan rose to become chief foreign affairs correspondent at the Tiffany Network. But her stint was marred by trauma after she was sexually assaulted by a violent mob while covering the 2011 political upheaval in Egypt.

- The two are expected to talk about trans issues and what ''womanhood'' means. Which is rich considering Mulvaney is a biological man who merely portrays a female on TikTok.
- Mulvaney, who is internet famous for documenting his transition into a woman, has been routinely slammed by critics for representing females in a seemingly mocking fashion.
- For example, people are calling for boycotts of the makeup supply chain Ulta Beauty after a recent company podcast episode where Mulvaney and another biologically male co-host discussed ''girlhood'' and motherhood.
- Calling the whole spectacle #womanface, a coined phrase similar to ''black face,'' people on the internet are accusing Mulvaney, Lopez, and Ulta Beauty of appropriating womanhood because both hosts are biological men.
- ''I can find love, I know I can still be a performer, I know I can have a family '-- I wanna be a mom one day, and I absolutely can,'' Mulvaney asserted in the episode promoted by Ulta.
- ''And that's why the narrative still has a long way to go, because, when I was grieving 'Boy Dylan,' I didn't even know those things were accessible to me,'' he added. ''There's much shame, so much stigma. I had this idea of trans-people and it was weird because I knew I was trans yet had transphobia of myself.''
